The Supreme Court is not required to hear the case but will likely do so due to its importance and the fact that the request is being made by the U.S. government. The first visa ban had included Iraq, but it is no longer on the list because of its efforts against ISIS.

The administration argues in its application that preventing Trump from "effectuating his national-security judgment will continue to cause irreparable harm to the interests of the government and the public".
