Trump Administration Asks US Supreme Court To Reinstate Travel Order

They will need to decide whether Mr Trump's order was meant to discriminate against Muslims.

Trump's "final, deliberative verdict was the same as his initial, gut-level one", the Post says, basing its "account of Trump's decision-making process" on interviews with "more than a dozen administration officials, Trump confidants, Republican operatives, and European diplomats".

"The courts below openly second-guessed the president's finding that those conditions and risks provided the basis for". It would also suspend the U.S. Refugee Admission Program for 120 days and lower the maximum number of refugees who can enter the 2017.

Last time Donald Trump's Muslim ban got shot down by an appeals court and Trump threatened "SEE YOU IN COURT", the Justice Department instead chose to rewrite the inherently flawed ban.

Last month, the Maryland district court's preliminary injunction was upheld by the 4th Circuit Court of Appeals, with the chief judge writing that the travel ban "drips with religious intolerance, animus, and discrimination".

In dissent, Judge Paul Niemeyer predicted, "The Supreme Court surely will shudder at the majority's adoption of this new rule that has no limits or bounds, one that transforms the majority's criticisms of a candidate's various campaign statements into a constitutional violation".

It also asked the Supreme Court to fast-track the case, which could result in the justices hearing it before its new term begins in the fall as the court normally disposes of all pending cases by the end of June.

Pence said the administration will 'advance what the president calls policies of extreme vetting'.

But Jadwat said Trump passed up a clear opportunity in front of many leaders of the Arab world "to explain or retract any of his earlier statements".

The Supreme Court, finally at full strength with the addition of Trump's nominee, conservative Justice Neil Gorsuch, has divided in the past on immigration issues.

Five of the nine justices have to vote "yes" for that to happen.

Kennedy wrote only for himself and Justice Samuel Alito in the 2015 case, but the opinion represented the controlling reasoning for the splintered court. His opinion came in the case of a USA citizen seeking to challenge the denial of her Afghan husband's visa application. The Justice Department appealed both rulings.

Trump's administration is battling temporary injunctions on the travel restrictions on two separate fronts through cases that originated in Hawaii and Maryland.

The challengers contest the administration's claim that urgent action is needed for national security reasons.

The Trump administration says the Constitution gives the president "broad authority to prevent aliens overseas from entering this country when he deems it in the nation's interest".

The Supreme Court is not required to hear the case but will likely do so due to its importance and the fact that the request is being made by the U.S. government. The first visa ban had included Iraq, but it is no longer on the list because of its efforts against ISIS.

The administration argues in its application that preventing Trump from "effectuating his national-security judgment will continue to cause irreparable harm to the interests of the government and the public".
