Bill Cosby trial: Judge declares mistrial after jury fails to reach verdict

Steadfast Cosby supporters can point to juror division as evidence of a prosecution case that was far from open-and-shut.

Cosby is charged with three counts of aggravated indecent assault that could put him in prison for the rest of his life.

"I have no authority to do this", Judge Steven O'Neill said in the 52nd hour of deliberations on Friday night.

RuPal took to Twitter to write, "Our criminal justice system is a joke that's not at all amusing".

Nevertheless, Cosby's legal and publicity team emerged onto the front steps of the courtroom triumphant.

Cosby lawyer Brian McMonagle fired back that jurors might be under the assumption they have to deliberate until "the cows come home".

With the help of attorney Gloria Allred, they compelled Cosby's wife, Camille Cosby, to sit for a deposition.

"I want to reiterate how proud I am of each and every one of you", O'Neill said as he sent the jury back to the hotel. She woke up the next morning in his home with her sweater bunched up and her bra undone, the affidavit says. "But why keep costing these citizens millions of dollars?"

Cosby's defense lawyers, however, argued that Constand's account could not be trusted after they pointed to numerous discrepancies in her statements to police in 2005, when she first reported the alleged incident almost a year later.

On behalf of Andrea Constand and ourselves, we would like to thank the dedicated individuals of the Montgomery County District Attorney's Office in particular Kevin Steele, Kristen Feden and Stewart Ryan and the many police officers and detectives who worked on this case, in particular Rich Schaffer, Jim Reape and Mike Shade.

"Our job in this, as prosecutors, [is to] take on the tough cases", said Steele. To Cosby, the judge asked the celebrity if he understood the meaning and consequences of a mistrial. "If you do, you're saying if someone is wealthy or famous, they don't deserve the same sort of justice as everybody else".

Dozens of women have come forward to say Cosby had drugged and assaulted them, but this was the only case to result in criminal charges. Steele said the case may be retried in 120 days, and that Constand would "cooperate" in a retrial.

The portion of Constand's testimony where she talks about telephone calls she made to Cosby after she says he drugged and violated her. As news reporters streamed out of the room, several other Cosby accusers, some in tears, waited in line to hug Constand, who smiled broadly and maintained her composure.

His lawyer said the entertainer and Constand were lovers sharing a consensual sexual encounter. Cosby did not testify in his own defense. As the days passed, the jury repeatedly asked to rehear portions of the testimony.

By Thursday morning, after almost 30 hours of discussions spanning three days, the jurors told O'Neill they were at a stalemate.

The jury tells the judge that it "cannot come to a unanimous consensus on any of the counts".

The jury was handed the case Monday evening, and retired after four hours to the hotel that has been their home throughout the trial.

Little testimony about other accusations against Cosby was allowed in the Pennsylvania trial because of the strict standards for admitting evidence in criminal cases. "Even before his late-career turn as black America's moral scold, Cosby had spent decades leaning into his popular image as a paternal figure to bolster his influence as a paternalistic one".

Constand testified Cosby then allegedly walked her to a couch and began to sexually assault her. Constand said she awoke in the middle of the assault, but felt paralyzed and "frozen" and could not move to force Cosby away. "Cosby gave money to the city, and whenever he could, his time", Annette John-Hall reported for NPR.

Victoria, a former Playboy model who has accused Bill Cosby of drugging and raping her decades ago, had a message for him: "You're not off the hook, buddy". Then Constand's allegations drew attention in 2005. Nearly a decade passed, and no criminal charges were filed.

Musical artist and producer Dready tweeted "Guilty or not, this trial will be a dark cloud over Bill Cosby's whole career forever". "Brings you down a couple notches".

"You leave here and Google 'Bill Cosby rape, ' " Buress told the audience.
