Geimer has asked authorities in the past to drop the case but Friday's appearance in superior court was her first formal request to do so in the past 40 years. She said she had suffered four decades of insults and mistreatment and has been hounded by the news media.

Polanski fled to France in 1978 after he pleaded guilty to having sex with a minor and shortly before he was to be sentenced in the case.

Geimer was 13 when she was drugged and raped by Roman Polanski in Los Angeles.

"I'm fine", Geimer added.

Polanski admitted to statutory rape and spent 42 days in prison, but fled to France in 1978 before being sentenced and has refused to return to the U.S. since.

Geimer also played down the severity of what happened to her, saying Polanski had apologised and that they had exchanged emails in recent years.

He went on to tell Geimer that she and her family deserve closure, but stopped short of making a final ruling, noting that Polanski himself has the power to end the case once and for all if he simply returns to the USA for sentencing.

The warrant prevented Polanski from collecting his Academy Award for best director for his 2002 film "The Pianist".

Under intense public scrutiny, the judge reneged on his promise, telling the attorneys in chambers that he would send Polanski back to prison for the remaining 48 days, after which the director would have to voluntarily deport himself or face a much lengthier sentence.

Braun believes the transcripts will show Polanski has already served the time called for in his deal. Nicholson was not at the residence at the time.

She told the judge she has "endured the pendency of this case for over 40 years" and said dismissal of the matter would be a "way to expedite a conclusion" to the case.

While most sex abuse victims are criticizing the government for stronger sentencing in an effort to curb the number of incidents and to feel vindicated in their specific cases, Geimer is taking the opposite approach.

On Friday morning, June 9, Geimer addressed the judge in the rape case, Judge Gordon, to do what the DA would not do, and finally drop the case against Roman Polanski.

Polanski's attorney is seeking to unseal testimony that he says would show judicial misconduct in the case years ago.
