The Delhi High Court on Thursday set aside Jawaharlal Nehru University's (JNU) decision holding former Students' Union president Kanhaiya Kumar and others guilty of indiscipline in the controversial February 9 event past year.

To be decided afresh after allowing the students to inspect the records and hearing them, Justice VK Rao remanded the issue back to the Jawaharlal Nehru University (JNU).

Thereafter, the appellate authority shall hear each of the students and subsequently, after considering the appeals filed by them, "pass a reasoned order as expeditiously as possible", preferably within six weeks from the date of hearing, the court said in its judgment.

The disciplinary action taken by JNU has been set aside by the Delhi High Court on Thursday.

The court said after inspection of records students shall have one week time to file a supplementary appeal, upon which the appellate authority shall give a hearing to them, and by considering the appeal (s) already filed by the students and the supplementary appeal, if any, it will pass a reasoned order as expeditiously as possible preferably within six weeks thereafter. Kanhaiya, Khalid and Bhattacharya were earlier arrested in a sedition case in connection with the February 9 event on the campus against hanging of Parliament attack convict Afzal Guru during which anti-national slogans were allegedly raised.

Apart from the charge of indiscipline against them, the students in their pleas had also challenged their punishment, which ranged from rustication for a few semesters to withdrawal of hostel facilities and fines.

While the appellate authority had reduced the fine of some students, for Khalid and Bhattacharya, the punishment remained the same.
