The Lord's outfit which won the Division One Championship in 2016 were docked two points for maintaining a slow over-rate during their encounter against Surrey in August which was abandoned when a crossbow bolt was sacked into The Oval.

The England and Wales Cricket Board agreed those exceptional circumstances warranted an appeal - not usually possible for over-rate offences - but the cricket discipline commission has upheld the punishment.

Middlesex chief executive Richard Goatley said the club would not seek to challenge the ruling.

"We are pleased that this has now been put to rest and we can concentrate on preparing for next season", he said. They were subsequently relegated by a single point after losing their final match of the season to Somerset.

Although no formal appeals process was available to Middlesex under the playing conditions, given the circumstances surrounding the incident and the apparent assurances given by the umpires, it was decided that the county and the European Central Bank should be allowed to send submissions to the CDC Chairman Tim O'Gorman for his review.

Cricket Discipline Commission chairman Tim O'Gorman said: "Middlesex have sought to argue that it was only because of the abandonment of the game that they did not make up their overs, but that can not be entirely correct".

Middlesex confirmed they had "made submissions to the chairman of the CDC over the issue" last week. "Play ended accordingly and the points earned or deducted should stand with effect from that time".
