This was sequel to a suit marked ECW/CCJ/APP/06/12, and filed before the Economic Community of West African States (ECOWAS) Court on May 2, 2012, by one Vincent Agu and 19 others against the Federal Government and five others.

Representatives of the victims of the Nigerian civil war, including the 493 victims enumerated by the Federal Ministry of Defence sued the federal government before the ECOWAS court in 2012 demanding N100 billion and another order of the court compelling government to clear and destroy all by post-civil war bombs and other unsafe weapons of war abandoned in their various communities and farmland since 1970.

A breakdown of the compensation adopted by the ECOWAS Court of Justice as consent judgment for government and the victims showed that N50 billion would go directly to the victims of the war in 11 affected states in the South-east, South-south and parts of the North-central region, while the remaining N38 billion would be used for the evacuation of abandoned bombs and other lethal weapons, as well as the construction of schools, courts, churches and mosques, among other social amenities in the affected areas.

It was reported that about 302 locations across Benue, Enugu, Abia, Cross River, Ebonyi and Delta, Akwa Ibom, Rivers, Anambra and Imo states were affected.

By the consent judgment, the Federal Government also agreed to construct one block of 10 classrooms for 50 communities now barred from using their school facilities because of the presence of bombs and other post-war relics.

Parts of the terms of settlement read, "That the Federal Republic of Nigeria undertakes to complete the de-mining and destruction of land mines and bombs in the Nigerian Civil War affected states of South-East, South-South and part of the North-Central geopolitical zones of Nigeria as contained in Schedule 1 to this Terms of Settlement".

The Federal Government has agreed to pay N88 billion as compensation to Biafra victims of the Nigeria civil war 47 years after the war ended. Construction of classrooms, provision of prosthetics etc. and all other activities enumerated there under.

The Federal Government on Monday agreed to pay a total of N88billion for the compensation of victims of the Nigeria/Biafra civil war, as well as for the reconstruction of areas destroyed by abandoned explosives within the South-East, South-South and North Central regions of the country.

It was also agreed that RSB Holdings Nigeria Ltd and Deminers Concept Nigeria Ltd having satisfactorily performed the first phase of clearing and destroying the post war bombs should be mobilized back to site to complete the final phase of the ongoing demining process.

The document was signed on behalf of the plaintiffs by Chief Noel Chukwukadibia, Alex Williams and Chiemeka Okereke.
