A right decision will be taken after studying the court order in detail and evaluating the NCP's stand. The court had earlier today dismissed a petition by Chandy, challenging a report by the Alappuzha district collector on alleged encroachments by a company in which he has stake.

The NCP executive meet here today discussed the matter and chose to inform the national leadership about its decision on it.

Tankha, who arrived here last evening, however maintained that he was appearing on behalf of Chandy in court in his professional capacity as a lawyer.

The division bench of the court of Justice P.N. Ravindran and Justice Devan Ramachandran came down heavily on Chandy and observed that it was very unusual what a state Minister has filed a petition against the state government "which questions the failure of the collective responsibility of the cabinet".

"Never before has the court made an observation that the cabinet has lost its collective responsibility".

Communist Party of India State secretary Kanam Rajendran on Tuesday said the High Court's adverse observations about the collective responsibility of the Cabinet were grave and hoped that the Chief Minister would take an appropriate decision as per the Left Democratic Front's position on Transport Minister Thomas Chandy's resignation. Chandy, a businessman-turned-politician, is NCP's only minister in the Cabinet.

According to reports in the media, it is in this context that the minister is mulling over moving the supreme court.

NCP state acting president T.P. Peethamabaran said a decision on Chandy would be taken by the NCP parliamentary board.

Chandy is the Nationalist Congress Party nominee in the LDF ministry.

The High Court further questioned whether the minister had any special consideration from the government in the case.

The opposition Congress-led UDF and the BJP have been demanding the resignation of Chandy over allegations of land encroachment.

Beleaguered Kerala minister Thomas Chandy today said he would quit if the observation against him is in the signed verdict of the high court on his petition against the Alappuzha district collectors report on alleged encroachments.
