Kenya's President Uhuru Kenyatta has called on the Supreme Court to throw out petitions challenging his election on October 26.

"It will not be possible to be able to answer two petitions; one which we've already answered and the other one which can not be answered", Ngatia told the Supreme Court bench under the leadership of Chief Justice David Maraga.

Kenyatta said in a statement on Sunday that the over ten petitioners' claims were unsubstantiated and a waste of judicial time and resources, reports local news portal Daily Nation.

Led by senior counsel Fred Ngatia and Ahmednasir Abdullahi, the battery of lawyers managed to convince the Supreme Court to expunge part of the evidence presented by the petitioners to corner the Independent Electoral and Boundaries Commission and President-elect Kenyatta.

The court also removed from the cause list for purposes of presidential petitions, a petition by the Institute for Democratic Governance (IDEG) and ordered that it will be heard separately after the conclusion of the two petitions challenging the October vote.

The unanimous ruling, on the second day of the court's review of the petitions, comes after it rejected the participation of opposition leader Raila Odinga's NASA coalition in the petitions.

"Article 163 (3) (a) is so broad such that it allows this court an exclusive jurisdiction to handle anything (dispute) relating to that election", lawyer Kioko Kilukumi.

The apex court also admitted the Attorney General into the Mue-Khalifa petition as an interested party.

The Mwau case is premised on arguments that the IEBC did not conduct fresh nominations for purposes of the October presidential election, having been ordered by the Supreme Court to conduct a fresh election after the court nullified the August 8 presidential contest.

The court has until Monday to make a ruling, being fourteen days following the filing of the petitions. If it upholds the result, Kenyatta will be sworn in on November 28.
