An assistant attorney general told Blakey his office would allow the school to administer the drug until his office can figure out how to address the state law.

The parents of an 11-year-old girl suffering from leukemia are suing a school district and the state of IL for not allowing their daughter to take medical marijuana at school.

The family asked the school district to store the medical marijuana on school grounds at Hanover Highlands Elementary in case it was necessary during the school day.

A federal judge says it's ok for an 11-year-old girl who suffered from leukemia to use medicinal marijuana at her suburban elementary school.

Prior to Friday's ruling, the family's lawsuit filed Wednesday against School District 54 cites the Individuals With Disabilities Education Act and the Americans with Disabilities Act for her right to receive treatment from the IL school district. "It's not a drug".

They also contend that denying her daughter the substance means she takes more time off school with illness, breaking a state law which requires her to go to school. "It hasn't caught up with reality".

Previously, the state's marijuana laws made it illegal for individuals to possess medical marijuana on school grounds or school property such as school buses.

The family agrees. They said the state's current medical marijuana laws do not meet reality. The district would not accommodate them, the suit said.

A lawyer for the school district said Schaumburg District #54 owes a debt of gratitude to Ashley's family for bringing the issue to light. "That's why I think it's mission critical the legislation be revised to reflect the effectiveness of these meds and how it benefits, not just our daughter, but for other students, other kids", said Jim Surin, Ashley's father.

Occasionally, when the patch is insufficient to control her seizures, she uses cannabis oil drops with small amounts of THC on her tongue or wrists to regulate her epilepsy, the suit stated.
