European Court advises all EU nations must recognise same-sex couples

European Court advises all EU nations must recognise same-sex couples

Same-sex spouses should be afforded the same rights to live and work across the European Union as married heterosexual couples, regardless of individual member countries' stance on same-sex marriage, a senior legal adviser to the European Union's top court said Thursday.

Today's decision is non-binding but the court often follows recommendations laid out by its advocates general.

"Although member states are free to authorize marriage between persons of the same sex or not, they may not impede the freedom of residence of an European Union citizen by refusing to grant his or her spouse of the same sex, a national of a non-EU country, a right of permanent residence in their territory", the senior adviser, Advocate General Melchior Wathelet, said in a statement released by the court.

The Luxembourg court is now deliberating in the case of a Romanian national, Adrian Coman, whose American husband, Claibourn Robert Hamilton, was refused residence in Romania based on the couple's 2010 marriage in Brussels.

Romania is one of the six EU member states that do not recognize the unions of gay couples.

Romania's Constitutional Court asked the European Court of Justice, which is based in Luxembourg, to weigh in with its legal interpretation of the case.

"We are overjoyed", Hamilton said in a written statement.

Same-sex unions remain hard in Romania. Like Romania, Poland, Slovakia, Bulgaria, Lithuania and Latvia do not give same-sex couples any legal rights or responsibilities.

Florin Buhuceanu, president of the Romanian advocacy group Accept, said that "such an inclusive definition of what family is in the 21st century will send a very clear sign to Romanian politicians".

"While member states are free to provide for marriage between persons of the same sex in their domestic legal system or not, they must fulfil their obligations under the freedom of movement of European Union citizens", they added.
