Clemency denied in the 'Stocking Strangler' case

Carlton Gary, known as the Columbus "Stocking Strangler", is scheduled for execution by lethal injection at 7 p.m. on Thursday, March 15.

The State Board of Pardons and Paroles plans to hold a closed-door clemency hearing Wednesday for Carlton Gary.

Gary was convicted on three counts each of malice murder, rape and burglary for the 1977 deaths of 89-year-old Florence Scheible, 69-year-old Martha Thurmond and 74-year-old Kathleen Woodruff.

Women between the ages of 55 and 89 became the target of nine rapes and seven strangulation deaths-sparking fear and sense of terror in the prosperous suburb.

Gary's lawyers say he's innocent, that the wrong man was arrested.

If the execution is carried out, Gary - who told Vanity Fair in 2007 that his eyes were damaged by a lack of light in jail prior to his trial - would be the first inmate executed in Georgia this year.

According to the Atlanta Journal-Constitution, Gary was also accused of killing four other women. DNA analysis would have provided further evidence, they wrote, but it couldn't be done because the samples were discovered to have been contaminated at the Georgia Bureau of Investigation crime lab. They say Gary's claims have repeatedly been rejected by the courts.

Gary's attorneys argued that the convicted murderer and rapist's execution date was "prematurely set", leaving him without time for a review by the US Supreme Court, which earlier set an April 16 deadline.

The lawyers claim that Gary is not the "Stocking Strangler" and that someone else is responsible for the multiple murders, the newspaper reported.

DNA testing done years after the trial on semen found on clothing worn by one of the women who survived does not match Gary, his lawyers wrote.

Additionally, defense experts testified that evidence of a bite mark on one of the victims that was missing for years does not match Gary's teeth, and fingerprint evidence relied upon by the prosecution was problematic. "We're just saying you can't execute him". They also are asking the court to weigh whether the destruction of possibly exculpatory evidence by the state violates those same constitutional rights.
