Metuh arrives court in wheelchair insists on being treated abroad

Olisa Metuh, former national publicity secretary of the Peoples Democratic Party (PDP), appeared in court on a wheelchair on Wednesday, demanding that his global passport be released to enable him travel overseas for medical treatment.

It told the court that the fund which was released to Metuh and his firm by detained former NSA, Col. Sambo Dasuki, retd, ‎ ‎was part of about $2.1billion earmarked for the purchase of arms to fight insurgency in the North East.

The trial judge, Justice Okon Abang, after listening to both counsels adjourned the case to March 15, 2018. for the continuation of trial.

Arguing the application for the release of Metuh's travel document yesterday, his counsel, told the court that the instant application was different from the two previous ones, which the court had heard and ruled on.

He said the granting of the application by the court will speed up the trial as Metuh will have no reason to be absent from court for his trial.

"He (Metuh) has lost sensation in his lower leg, this never happened before so this reinforces the fact that the circumstances of this application are different".

According to Etiaba, the exercise of discretion is always based on the material made available to the court and the ruling on the last two applications was based on material made available to the court at that time.

He said that his client, by the fresh application, was presenting a new case before the court in line with the new fact that had emerged and prayed the court to consider the application.

He said: "We rely on exhibit three, which is a letter from a world renowned neurosurgeon by name Adrian Cassy and the prosecution can bring its team of medical experts to examine the first defendant".

In his response, Justice Abang demanded that both the prosecution and defence lawyers address him on whether the court could grant Metuh's request understanding that he previously dismissed two similar applications on May 25, 2016 and on February, 2017.

According to him, the only thing different about the latest application is the timing because the circumstance, which is the release of worldwide passport on the grounds of ill health remains the same.

The court also ordered the former PDP spokesman to also submit his global passport to the Registrar of the court as part of the conditions for his bail.

Abang had earlier refused another application seeking permission for Metuh, who appeared in court on a wheelchair, to be absent from the proceedings based on his health.
