More than two dozen states have sued the FCC or proposed their own internet regulations to reinstate the Obama-era rules.

Carriers and cable companies will now be able to give priority to companies they partner with, and slow down traffic for those they don't.

The FCC voted in December to rescind regulations enacted during the Obama administration to establish the principle that Internet service providers should treat all Web traffic equally, without giving preferential treatment to any Web company, service or content. Other states are mulling over the implementation of executive orders that restrict the state from working with a broadband business that disregards the rudimentary concepts of net neutrality.

The new order permits ISPs to throttle, block, or be paid to prioritize certain sites or content, as long as they disclose that they are doing so.

"The United States is simply making a shift from pre-emptive regulation, which foolishly presumes that every last wireless company is an anti-competitive monopolist, to targeted enforcement based on actual market failure or anti-competitive conduct", he said.

The FCC said it had repealed the rules because they restrained broadband providers like Verizon and Comcast from experimenting with new business models and investing in new technology.

As part of this shift, oversight of internet protections will shift from the FCC to the Federal Trade Commission.

Opinion polls show overwhelming public support for the net neutrality rules. Various advocacy groups are still pushing to save the rules through legislation and litigation. But the Republican-led House, and President Trump, are both thought to be unlikely to back the Senate's measure.

"The gutting of net neutrality is a symbol of our broken democracy", Fight for the Future Deputy Director Evan Greer said in a statement. "But it has sparked an unprecedented backlash from across the political spectrum, and Internet users are coming out of the woodwork to fight tooth and nail in Congress, in the courts, and at the local and state level".

Net neutrality looks set to partially live on regardless, as some U.S. states are enacting legislation that will require telecoms companies operating in their territories to abide by similar laws.
