Australia passes controversial encryption bill

Australia wants to compel tech firms to hand over encrypted data

Under the deal, the coalition government agreed to add amendments next year.

But what do these laws actually mean, and why are they so controversial?

According to Reuters, the bill should affect Apple, Google, Facebook, Snapchat and any other technology company that is based in Australia and encrypts Australian users' communications. In fact, it has specific language that prevents the government from demanding technology providers introduce a "systemic weakness or systemic vulnerability" into their products in order to provide access for law enforcement.

Labor said its support was contingent on the government amending the new laws in February.

A major feature of the laws is that australian authorities will also be able to require that those demands be kept secret. Probably not, but it's concerning that there's now a law that would allow such a thing.

The law is also technically vague and seems contradictory because it doesn't require systematic weaknesses - so-called "back doors" - to be built in by tech providers.

Cyber-security experts have warned the laws could now create a "global weak point" for companies such as Facebook and Apple.

Opponents argue it will weaken Australians' online security and privacy.

On Twitter Thursday, Australian Greens' party Senator Jordon Steele-John called the bill "dangerous" and an "affront to privacy and democracy".

"Far from being a "national security measure" this bill will have the unintended effect of diminishing the online safety, security and privacy of every single Australian", Senator Steele-John wrote earlier this week.

Mr Husic said this week's outcome was "not a flawless endpoint" and "there will be people who wonder why we did what we did".

"The iPhone is national security infrastructure right now, " said Schneier.

The Law Council said it was unacceptable that the laws were passed while so many in the parliament acknowledged there were ongoing problems.

Canberra says the laws are needed to intercept communications between serious criminals, like terrorists and paedophiles.

"I think it's detrimental to Australian and world security, " said Bruce Schneier, a tech security expert affiliated with Harvard University and IBM.

"We will pass the legislation, inadequate as it is, so we can give our security agencies some of the tools they say they need", Shorten said.

"Even though the government is trying to make it sound that decryption will help police and government agencies, in fact, it will just open the door to new crime", said Ruby Gonzalez, Communications Director at NordVPN.

"The commission, and the public, have not been given a sufficient opportunity to review and comment on yesterday's amendments prior to them becoming law".

"Failing to properly scrutinize this bill risks unintended consequences which may impact on the privacy and rights of law-abiding Australian citizens, the media and corporate sector", Arthur Moses, president-elect of the Law Council of Australia, said earlier this week.

How technology companies will be expected to comply with technical assistance requests or warrants resulting from the new law is the big question.

He noted that the opposition Labor Party "had to be dragged to the table" and backed the legislation as an emergency measure out of concern extremists could target Christmas-New Year crowds.

"I thought it was important that we reach at least a sensible conclusion before the summer on the important matter of national security", he told reporters.
