Tom Petty's daughters are suing his widow for $5million in damages over the late singer's unreleased music in the latest familial dispute over his estate.

But according to his daughters Adria Petty and Annakim Violette, the will also gives them "equal participation" on decisions, which they believe Dana has ignored, reports Forbes.

According to court documents obtained by The Blast, Petty Unlimited claims that Dana and others have breached their fiduciary duties to the company by withholding certain assets and diverting them to another company she set up.

Adria and Annakim are seeking more than $5 million in damages that they claim they lost directly through Dana "usurping" their business opportunities "for her own personal gain or advantage... for the objective of depriving Plaintiff of those opportunities and the benefits thereof".

Petty's surviving family has been locked in a legal battle since he died in October 2017 at age 66 of an accidental drug overdose.

In the end, Dana is asking a judge to appoint a day-to-day manager for the estate.

Her late husband left Dana in charge of his legacy and recordings but insisted his two daughters from a previous marriage had a say in all major decisions.

In April, Dana Petty filed a probate to put the catalog in the hands of a professional manager.

"Tom Petty wanted his music and his legacy to be controlled equally by his daughters, Adria and Annakim, and his wife, Dana", said Petty Unlimited attorney Alex Weingarten in a statement to PEOPLE.

Last month, Petty's widow accused Adria and Annakim of trying to hinder her role as trustee, making it impossible to manage the lucrative estate, according toTMZ.

In her petition, Dana claims "she has gone above and beyond to seek to work cooperatively with Tom's daughters" but they have made that hard. She argued that Adria Petty had been erratic and abusive, and had made it hard to conduct business in an orderly way.

The petition further claimed that Adria's actions held up the release of a posthumous hits compilation, in addition to a 25th anniversary edition of Petty's 1994 solo LP Wildflowers complete with previously unheard music. At that time, Adria filed her own petition with the court accusing Dana of not setting up the LLC so she can have sole control of the "artistic properties".
