The U.S. Food and Drug Administration issued a warning letter to JUUL Labs Inc. for marketing unauthorized modified risk tobacco products by engaging in labeling, advertising, and/or other activities directed to consumers, including a presentation given to youth at a school.

One of these was a traditional warning letter, informing JUUL that the agency considered its marketing materials to be claiming its devices are "modified risk tobacco products", a category that requires manufacturers to conduct rigorous studies and submit the evidence for approval - which JUUL has not received.

The FDA has also asked Juul to provide a written response within 15 days outlining its plan to correct its violations and to provide requested documents and information within 30 days of the date of the letter. "JUUL has ignored the law, and very concerningly, has made some of these statements in school to our nation's youth", Sharpless said.

The in-school presentations central to the FDA's latest concerns came to light during a Congressional hearing held July 24 and 25, titled "Examining JUUL's Role in the Youth Nicotine Epidemic". We've also put the industry on notice: "If the disturbing rise in youth e-cigarette use continues, especially through the use of flavors that appeal to kids, we'll take even more aggressive action".

The letter also sought documents related to JUUL's efforts to commission research by outside contractors (including, reportedly, an organization that has worked for other tobacco companies) and academic scientists.

A spokesperson for JUUL told UPI, "We are reviewing the letters and will fully cooperate", but did not have further comment on the details of either letter. "The alternative for adult smokers". "We need to do all we can to protect the public from tobacco-related disease and death, and prevent e-cigarettes from becoming an on-ramp to nicotine addiction for a generation of youth".

Federal health jurisdictions damned vaping mammoth Juul for illegitimately flinging its electronic cigarette as a more secure replacement to smoking and instructed the company to halt making fabricated claims for its products. Yet, the agency noted, the company has made many unsubstantiated claims along those lines.

On Tuesday, Kansas health officials confirmed that state's first death tied to a vaping-related lung illness, following similar deaths in Minnesota, Indiana, Oregon, Illinois and Los Angeles.

US Senate Democratic Whip Dick Durbin pointed out in a press conference on Monday how Sharpless' predecessor, Dr. Scott Gottlieb, called vaping among youth an "epidemic". "The word gets out quickly in the retail community", he said.

JUUL "was much safer than cigarettes" and that "FDA would approve it any day".

"Witnesses testified, for example, that Juul advertising saturated social-media channels frequented by underage teens and that Juul used influencers and discount coupons to attract new customers", a letter, signed by Center for Tobacco Products director Mitchell Zeller, states.
