An Iowa appeals court has rejected Benjamin Schreiber's claim

"Schreiber is either still alive, in which case he must remain in prison, or he is actually dead, in which case this appeal is moot", Judge Amanda Potterfield wrote, according to the Register. Then again, Schreiber argued that he was sentenced to existence in jail, "but not to existence additionally one particular working day", the newspaper described.

He has filed several unsuccessful appeals, but in 2018 he argued in court in Wapello County that he had been resuscitated against his will, and that because he had, his "sentence has expired".

That's what a convicted murderer is claiming in Iowa.

They said that it was "unlikely" to be dead, as he had signed his own legal documents in the case.

Benjamin Schreiber was hospitalized in 2015 after large kidney stones caused him to develop septic poisoning, according to court records.

Out of nowhere, the prisoner fell unconscious in his cell and was taken to a local hospital, where he was resuscitated five separate times.

His argument said his imprisonment was illegal because he believed his sentence ended when he temporarily died.

However, a lower court didn't buy it.

Wednesday, November 6, the Iowa Court of Appeals ruled Schreiber would stay in prison.

"The court finds this assertion unpersuasive and without merit", it stated.

Potterfield added that there were "no conceivable state of facts" to support Schreiber's claim, noting the 66-year-old didn't cite any previous case law in his appeal.

On Oct. 13, 1997, Schreiber was found guilty of first-degree murder in the killing of John Dale Terry a year earlier. The courts have not addressed whether he was wrongfully resuscitated.
