Justice Dept. Closes Case Against ex-FBI Deputy Director Andrew McCabe

Rift grows as Barr backs off Trump rival McCabe

He has said his 2018 firing - for what the Justice Department called "lack of candor" - was politically motivated.

The Justice Department said Friday it will not pursue criminal charges against former FBI deputy director Andrew McCabe, after a almost two-year-long investigation into accusations brought by the agency's independent watchdog who claimed that he lacked "candor" when questioned about leaking to the media.

Despite saying he was happy with the conclusion, McCabe called it an "absolute disgrace" that the DOJ and USA attorney's office took two years before they "finally drew the obvious conclusion".

"Just so glad that my kids don't have to live with this anymore", McCabe, a frequent target of President Donald Trump's wrath, said.

Former Attorney General Jeff Sessions fired McCabe in March 2018 after the inspector general found he had repeatedly misstated his involvement in a leak to The Journal regarding an FBI investigation into the Clinton Foundation.

A lifelong Republican who worked at the FBI for 20 years, McCabe played a crucial role in the bureau's investigations of Democratic presidential candidate Hillary Clinton and Russian interference in the 2016 USA election.

He was sacked in March, hours before he was set to retire.

In a letter on Friday, prosecutors told McCabe's lawyers that they decided "not to pursue criminal charges against your client" after careful consideration.

"We said at the outset of the criminal investigation, nearly two years ago, that if the facts and the law determined the result, no charges would be brought", they said.

"To have this horrific black cloud that's been hanging over me and my family for nearly the last two years, to have that finally lifted is just an unbelievable - it's a relief I'm not sure I can really explain to you adequately", McCabe said.

The investigation by the USA attorney's office in Washington arose from an October 2016 story in The Wall Street Journal that described internal debates roiling the FBI and the Justice Department weeks before the presidential election about how aggressively the Clinton Foundation should be investigated. Stone had faced seven to nine years in prison until top officials at the DOJ intervened earlier this week.

Facing the prospect of potential further resignations, Barr spoke out Thursday in an interview with ABC News in which he admonished President Donald Trump for tweets attacking a district judge and congratulating Barr for "taking control" of the Stone case.

Trump then posted that Stone's sentencing and case were both "horrible" and "unfair".

Following that unprecedented intervention, all four line prosecutors withdrew from the case in protest, with one resigning from the Justice Department entirely.

The president has since responded to Barr's remarks on Friday, writing on Twitter that he has the "legal right" to intervene on investigations but has chosen not to do so.

For several years now, Trump has called for the prosecution of several former Federal Bureau of Investigation officials, including McCabe and Comey. Horowitz, in a separate report released past year, found there were "at least 17 significant errors or omissions in the Carter Page FISA applications and many errors in the Woods Procedures".
